Terms and conditions
Version of 29 October 20261. Scope
These terms govern the paid services offered under the Tilka brand by Sébastien Potet, sole proprietorship (S. Potet Advisory), hereinafter “Tilka”: verified report, renewal and support. They are intended for businesses. The free online assessment is not a contractual service. Its use, and the use of the indicative rating it produces, are subject to the rating usage charter.
2. Orders
The contract is concluded by online payment or by written acceptance of a Tilka quote or invoice.
3. Prices and payment
The prices that apply are those published on the Pricing page at the time of ordering, or those in the written quote, in Swiss francs. The verified report is payable when ordered. Support is invoiced according to the quote.
4. Content of the verified report
Tilka matches the data declared by the customer against the supporting documents provided, redoes the calculations using the method published on tilka.ch, corrects discrepancies with the customer and delivers a signed report together with a results call. The verification is not an audit, an assurance engagement under ISAE 3000 or a legal compliance review. It does not include a site visit.
5. Customer obligations
The customer provides accurate and complete information and documents within 60 days of ordering. The customer remains responsible for the accuracy of the data declared. A data point that cannot be supported appears at the “declared” level in the report.
6. Timing and cancellation
The report is delivered within 10 working days of receiving all required documents. The customer may cancel free of charge as long as the verification has not started. Once the check has started, the price remains due. If documents are not provided within 60 days, Tilka may close the file.
7. Use of the rating and charter
The customer may share the verified report with anyone. For 12 months from its date, the customer may share the verified rating, with the financial year and verification code, in line with the rating usage charter, which forms part of these terms. The right to use the verified rating is acquired by paying for the service. The customer agrees to the rating being listed in the public register on tilka.ch (company name, town, letter, financial year, code and expiry date). Tilka may withdraw the rating and mark it as withdrawn in the register if information provided proves inaccurate, if the charter is not followed or if the service is not paid. The customer then stops using it within 30 days.
8. Confidentiality
Tilka treats the customer's information and documents confidentially and does not cite the customer as a reference without consent. The processing of personal data is described in the privacy policy.
9. Liability
Tilka is liable for damage caused intentionally or through gross negligence. Any further liability is excluded to the extent permitted by law. In all cases, liability is limited to the price paid for the service concerned. Tilka is not liable for decisions made by third parties (customers, banks, contracting authorities) on the basis of the report.
10. Intellectual property
The rating method, the tool, the report templates, the Tilka name and the A to E label remain the property of S. Potet Advisory. The customer receives a right to use the report delivered.
11. Changes
Tilka may change these terms. The version in force at the time of ordering applies.
12. Governing law and jurisdiction
Swiss law applies. The place of jurisdiction is the domicile of Sébastien Potet.
